Payment Bond Terms - Sky
Sky may charge you a bond ("Payment Bond") as security for payment of the services that we provide to you. If Sky does require a Payment Bond from you as a condition of providing Sky services, then you agree that these Payment Bond Terms shall apply between you and Sky as an Additional Term to Sky's Domestic Subscription Terms and Conditions.If SKY considers that a Payment Bond is required:
- you will be asked to pay the Payment Bond, along with any joining fee and the relevant fee for the first month's Sky services, prior to any Sky services being activated;
- payment can be made via credit card at the time of applying for Sky services or paid to the Sky technician on the day Sky services are activated.
The Payment Bond will:
- for domestic customers, not exceed a sum of $150;
- not bear interest while in Sky's possession;
- be held by Sky as stakeholder in a separate account (during which time Sky will not have any proprietary interest in the Payment Bond), until and unless the Payment Bond is applied or refunded in accordance with these Payment Bond Terms;
- be held by Sky for a minimum period of 12 months, and may be used by Sky to meet:
- any late or missed subscription payments on your account (in which case Sky reserves the right to also terminate your account in accordance with clause 13 of Sky's Domestic Subscription Terms and Conditions); and/or
- if your account is terminated:
- any early termination fee that is payable as a result of termination of your contract prior to the minimum term (in accordance with clause 14(c) of Sky's Domestic Subscription Terms and Conditions); and/or
- the costs of replacing the Decoder provided to you if you fail to return that Decoder to Sky on termination of the contract (in accordance with clause 14(b) of Sky's Domestic Subscription Terms and Conditions);
- be transferred to a new subscriber account in your name if you move address and continue to be a Sky customer at a new address; and
- less any amounts you owe Sky (as described in paragraph 4 above), be repaid to you after 12 months' satisfactory payment history by crediting your account. If Sky considers that you have not maintained a satisfactory payment history, Sky may consider it necessary to hold the bond for a longer period as a condition of continuing to provide you with Sky services.
